Speaker of a State Legislative Assembly โ Article 178
Article 178 of the Constitution provides that every Legislative Assembly of a State shall, as soon as may be, choose two of its members to be Speaker and Deputy Speaker respectively; and so often as the office becomes vacant, the Assembly shall choose another to fill the vacancy. Article 179 lays down how a Speaker or Deputy Speaker vacates office โ (a) by ceasing to be an MLA, (b) by resignation in writing to the other, or (c) by removal by a resolution of the Assembly passed by a majority of all the then members of the Assembly, after 14 days' notice. Article 180 deals with the power of the Deputy Speaker (or other person) to perform the Speaker's duties when the office is vacant. Article 181 prohibits the Speaker from presiding over a sitting in which a resolution for his removal is under consideration. Article 185 bars salary and allowances charged on the Consolidated Fund from being voted on; the Speaker's salary is so charged.
Powers and functions of the Speaker
The Speaker is the presiding officer of the Assembly. Powers include: (a) maintaining order, conducting business and adjourning sittings; (b) interpreting the rules of procedure and the Constitution within the House; (c) deciding the admissibility of questions, motions, resolutions and adjournment notices; (d) certifying Money Bills (analogous to Article 199 at state level); (e) deciding disqualifications under the Tenth Schedule (Anti-Defection Law) in the Assembly; (f) casting vote in case of a tie (the Speaker does not vote in the first instance); (g) constituting committees of the House and nominating chairs; (h) representing the Assembly in its dealings with the Governor and other authorities. The Speaker is the final authority within the House and cannot be questioned on procedural matters in court under Articles 212/122.
Pro tem Speaker
A pro tem Speaker (Latin: 'for the time being') is appointed by the Governor (Article 180 read with practice) at the start of a newly elected Assembly. The pro tem Speaker is usually the senior-most member of the new House. Functions: (a) administering the oath of office to the newly elected MLAs (under Article 188 read with the Third Schedule), and (b) presiding over the election of the regular Speaker. Once the regular Speaker is elected, the pro tem Speaker's role ends. In this case, Tapas Roy served as pro tem Speaker and conducted the voice vote that confirmed Rathindra Bose's election.
